Terms & Policies

Last updated on: December 10, 2020

Our privacy commitment: OWFB (Office with Financialsbook.com) has never sold your information to someone else for advertising, or made money by showing you other people's ads, and we never will. This has been our approach for almost 20 years, and we remain committed to it. This policy tells you what information we do collect from you, what we do with it, who can access it, and what you can do about it.

This Privacy Policy statement is made by the OWFB Group consisting of all the entities listed here (collectively, "OWFB", "we", "us" or "our") and is effective as of 25th Feb 2021. It applies to all our OWFB divisions.

1. Account Terms:

  • To access and use the Services, you must register for an OWFB account (“Account”) by providing your full legal name, current address, phone number, a valid email address, and any other information indicated as required. OWFB may reject your application for an Account, or cancel an existing Account, for any reason, in our sole discretion.

  • You must be the older of: (I) 18 years, or (ii) at least the age of majority in the jurisdiction where you reside and from which you use the Services to open an Account.

  • You confirm that you are receiving any Services provided by OWFB for the purposes of carrying on a business activity and not for any personal, household or family purpose.

  • You acknowledge that OWFB will use the email address you provide on opening an Account or as updated by you from time to time as the primary method for communication with you. You must monitor the primary Account email address you provide to OWFB and your primary Account email address must be capable of both sending and receiving messages. Your email communications with OWFB can only be authenticated if they come from your primary Account email address.

2. OWFB Privacy Commitment:

  • OWF has worried about customer and user privacy for almost 10 years, long before it became fashionable, politically correct, or legally binding to take such a position. We ask for only the least amount of information necessary, gathering only what we believe is essential for doing business, or for the specific transaction at hand.

  • We let customers know the information we have on them and allow them to opt out of specific engagements. But, by far, our biggest commitment is that we do not make a single dollar from advertising revenue—never have, never will—even from the free editions of our products. This means we avoid the fundamental conflict of interest between gathering customer information and fueling advertising revenue, and the unavoidable compromises in customer privacy that it brings.

  • The goal of this policy is to make explicit the information we gather on our customers and users, how we will use it, and how we will not. This policy is unfortunately longer than we would like, but we must unambiguously address all the relevant cases. We will try and keep the language simple and direct as much as possible.

3. Information OWFB collects and controls:

  • We only collect the information that we actually need. Some of that is information that you actively give us when you sign up for an account, register for an event, ask for customer support, or buy something from us. We store your name and contact information, but we don't store credit card numbers (except with your permission and in one of our secured payment gateways).

  • When you visit one of our websites or use our software, we automatically log some basic information like how you got to the site, where you navigated within it, and what features and settings you use. We use this information to improve our websites and services and to drive new product development.

  • Sometimes we receive information indirectly. If you ask about our products through one of our referral programs or reselling partners, or sign in to one of our products through an authentication service provider like LinkedIn or Google, they'll pass on your contact information to us. We'll use that information to complete the request that you made. If you engage with our brand on social media (for instance, liking, commenting, retweeting, mentioning, or following us), we'll have access to your interactions and profile information. We'll still have that information even if you later remove it from the social media site.

4. What we do with your information:

  • We use your information to provide the services you've requested, create and maintain your accounts, and keep an eye out for unauthorized activity on your accounts. We also use it to communicate with you about the products you're currently using, your customer support requests, new products you may like, chances for you to give us feedback, and policy updates. We analyze the information we collect to understand user needs and to improve our websites and services

  • We're required to have a legal basis for collecting and processing your information. In most cases, we either have your consent or need the information to provide the service you've requested from us. When that's not the case, we must demonstrate that we have another legal basis, such as our legitimate business interests.

  • You can decline certain kinds of information use either by not providing the information in the first place or by opting out later. You can also disable cookies to prevent your browser from giving us information, but if you do so, certain website features may not work properly. We completely disable third-party cookies from all OWFB websites and products.

  • We limit access to your personal information to our employees and contractors who have a legitimate need to use it. If we share your information with other parties (like developers, service providers, domain registrars, and reselling partners), they must have appropriate security measures and a valid reason for using your information, typically to serve you.

5. OWFB Rights:

  • We reserve the right to modify or terminate the Services for any reason, without notice at any time. Not all Services and features are available in every jurisdiction and we are under no obligation to make any Services or features available in any jurisdiction.

  • We reserve the right to refuse service to anyone for any reason at any time.

  • Verbal or written abuse of any kind (including threats of abuse or retribution) of any OWFB customer, OWFB employee, member, or officer will result in immediate Account termination.

  • In the event of a dispute regarding Account ownership, we reserve the right to request documentation to determine or confirm Account ownership. Documentation may include, but is not limited to, a scanned copy of your business license, government issued photo ID, the last four digits of the credit card on file, your status as an employee of an entity, etc.

6. OWFB POS Services:

In addition to the terms applicable to Services generally, the following terms apply to your access and use of the POS Services. The POS Services include the OWFB POS software (“POS Software”), the OWFB POS website, located at /pos, programs, documentation, apps, tools, internet-based services and components, OWFB POS hardware (“POS Equipment”) and any updates thereto provided to you by OWFB.

  • Access to and use of the POS Services requires that you have an active and valid Account.

  • If your POS Services are enabled with OWFB Payments, you cannot concurrently use any other payment processing service. The payment gateway used for your POS Services must be the same as that used for your Online Services, if applicable.

  • You can terminate your POS Services without terminating your Account or any other Services you subscribe to, and in such case, you will continue to be billed, and will pay for, the Services (other than the terminated POS Services).

  • The Fees for POS Services shall be determined based on the number of locations at which you are using the POS Services. Locations are defined by business address and are used for associating orders with a specific business address. Locations are added through the OWFB web administrative console associated with your Account.

7. Payment of Fees:

  • You will pay the Fees applicable to your subscription to Online Service and/or POS Services (“Subscription Fees”) and any other applicable fees, including but not limited to applicable fees relating to the value of sales made through your account when using all payment providers other than OWFB Payments (“Transaction Fees”), and any fees relating to your purchase or use of any products or services such as OWFB Payments, POS Equipment, shipping, apps, Themes, domain names, Experts Marketplace, or Third Party Services (“Additional Fees”). Together, the Subscription Fees, Transaction Fees and the Additional Fees are referred to as the “Fees”.

  • You must keep a valid payment method on file with us to pay for all incurred and recurring Fees. OWFB will charge applicable Fees to any valid payment method that you authorize (“Authorized Payment Method”), and OWFB will continue to charge the Authorized Payment Method for applicable Fees until the Services are terminated, and any and all outstanding Fees have been paid in full. Unless otherwise indicated, all Fees and other charges are in U.S. dollars, and all payments shall be in U.S. currency.

  • Subscription Fees are paid in advance and will be billed in 30 day intervals (each such date, a “Billing Date”). Transaction Fees and Additional Fees will be charged from time to time at OWFB discretion. You will be charged on each Billing Date for all outstanding Fees that have not previously been charged. Fees will appear on an invoice, which will be sent to the Account Owner via the email provided. As well, an invoice will appear on the Account page of your Account administration console. Users have approximately two weeks to bring up and settle any issues with the billing of Subscription Fees.

  • If we are not able to process payment of Fees using an Authorized Payment Method, we will make a second attempt to process payment using any Authorized Payment Method 3 days later. If the second attempt is not successful, we will make a final attempt 3 days following the second attempt. If our final attempt is not successful, we may suspend and revoke access to your Account and the Services. Your Account will be reactivated upon your payment of any outstanding Fees, plus the Fees applicable to your next billing cycle. You may not be able to access your Account during any period of suspension. If the outstanding Fees remain unpaid for 60 days following the date of suspension, OWFB reserves the right to terminate your Account.

  • You are responsible for all applicable Taxes that arise from or as a result of your subscription to or purchase of OWFB products and services. To the extent that OWFB charges these Taxes, they are calculated using the tax rates that apply based on the billing address you provide to us. Such amounts are in addition to the Fees for such products and services and will be billed to your Authorized Payment Method. If you are exempt from payment of such Taxes, you must provide us with evidence of your exemption, which in some jurisdictions includes an original certificate that satisfies applicable legal requirements attesting to tax-exempt status. Tax exemption will only apply from and after the date we receive evidence satisfactory to OWFB of your exemption. If you are not charged Taxes by OWFB, you are responsible for determining if Taxes are payable, and if so, self-remitting Taxes to the appropriate tax authorities in your jurisdiction.

  • For the avoidance of doubt, all sums payable by you to OWFB under these Terms of Service shall be paid free and clear of any deductions or withholdings whatsoever. Other than Taxes charged by OWFB to you and remitted to the appropriate tax authorities on your behalf, any deductions or withholdings that are required by law shall be borne by you and paid separately to the relevant taxation authority. OWFB shall be entitled to charge the full amount of Fees stipulated under these Terms of Service to your Authorized Payment Method ignoring any such deduction or withholding that may be required.

8. Cancellation and Termination:

  • You may cancel your Account and terminate the Terms of Service at any time by contacting OWFB Support and then following the specific instructions indicated to you in OWFB response.

  • Upon termination of the Services by either party for any reason:
    • OWFB will cease providing you with the Services and you will no longer be able to access your Account;
    • unless otherwise provided in the Terms of Service, you will not be entitled to any refunds of any Fees, pro rata or otherwise;
    • any outstanding balance owed to OWFB for your use of the Services through the effective date of such termination will immediately become due and payable in full; and

  • If you purchased a domain name through OWFB, upon cancellation your domain will no longer be automatically renewed. Following termination, it will be your sole responsibility to handle all matters related to your domain with the domain provider.

  • If at the date of termination of the Service, there are any outstanding Fees owing by you, you will receive one final invoice via email. Once that invoice has been paid in full, you will not be charged again.

  • We reserve the right to modify or terminate the OWFB Service, the Terms of Service and/or your Account for any reason, without notice at any time (unless otherwise required by applicable law). Termination of the Terms of Service shall be without prejudice to any rights or obligations which arose prior to the date of termination.

  • Fraud: Without limiting any other remedies, OWFB may suspend or terminate your Account if we suspect that you (by conviction, settlement, insurance or escrow investigation, or otherwise) have engaged in fraudulent activity in connection with the use of the Services.

9. Privacy & Data Protection

OWFB is firmly committed to protecting the privacy of your personal information and the personal information of your customers. By using the Service, you acknowledge and agree that OWFB collection, usage and disclosure of this personal information is governed by our Privacy Policy.
